6/ You may only claim for the INITIAL amount you paid.

8/ Don't be disheartened if you are refused the first time. Banks and Credit Card Companies are not charities. They want to make money, not give it away. They ARE refusing but I've had messages from affiliates who HAVE re-applied and HAVE received their money back.

Every bank and CCC has a customer call centre and it's much better (if you can) to speak to an actual person to ask advice rather than rely on a faceless email that can be discarded or misconstrued. Better still, if you have a bank branch near you, go inside and see them personally.

DO NOT GO THROUGH RETAIL DISPUTES
But be warned:
They will each offer you their own INTERPRETATION of how Chargeback works.
Some of them are positive and encouraging and will give you their own Chargeback forms to fill in. Others are NOT helpful. Be prepared for a long process if necessary.

A Chargeback is not guaranteed and if you are refused, please keep in mind that when ZEEK REWARDS was closed down, the authorities seized money/assets and the affiliates were/are receiving some/all of there money back.
IT MAY TAKE SOME TIME so make sure you put all the evidence in a safe place for future reference.

There are two time limits that concern chargeback, one is 120 days and the other is 540 days.
The 120 day countdown starts from the moment you realise you have a problem with the product you've bought, either after you receive it and discover it's faulty, if it doesn't arrive or if an event that you've paid for has been cancelled.
Claims can be made after 120 days if, for example, you have paid for a service a long time in the future, such as concert tickets or a flight booking, which are then cancelled and you can't get a refund from the provider (ie. if the airline goes bust).
The cut-off point for these claims is 540 days from the date of the transaction.
So, if you book something and discover 540 days later you won't get it, then the 120 day countdown would start. If it was 541 days after the transaction however, you would not be able to claim for chargeback.

Hi Tara, Having worked in banking for 20 years previously, I would tell anyone having difficulty with either their banks or building societies in the UK in respect of a Charge Back to go directly to The Financial Ombudsman Service (FOS) in London and send them a written complaint. You must go direct to the Fraud Dept of your bank or credit card company. Do NOT mess about talking to the Indians, go to the Chiefs!! Some banks will try and palm you off, hoping you will get fed up and go away!!! They did it with the PPI scandal and they will do it with this!!! If your bank gives you any b/s regarding your claim, simply tell them you are referring your claim to the FOS and they will then be liable for interest as well as compensation for your costs. The Financial Ombudsman Service are at South Quay Plaza, 183 Marsh Wall,London, E14 9SR & phone no is 0207 9641000. If you invested in BB using a credit card then they are liable under Section 75 of the Consumer Credit Act 1974. If you used some other payment method, then you can claim back using Charge Back. I was born in NZ and have an Australian passport. I have lived in the UK for nearly 30 years and can tell you that it is similar in both Australia & NZ to make claims back from your banks there. Good afternoon, folks - So I just got off the phone after ringing my bank (Lloyds) for the second time in talking to the disputes team about Bankers Broker and trying to get a chargeback. The first time I rang the other week, the lady told me I couldn't do anything as it was longer than 120 days. Well after I read the post on that Tara Talks blog site about the 120 days vs 540 days claim for chargeback, I rang again.

This time I spoke to a very helpful guy who told me after I explained a few things that the admin team would proceed with refunding my money although this could be pending on them requiring further information from me (which is what I expected). If successful, he told me I would receive my money back in 10 days as that's how long it takes the investigating team to look into it and process any monies back etc.
So what I'm basically saying is get on to you bank whoever it is, speak to the disputes team and TELL THEM that you are making the claim for chargebacks because BB simply did NOT deliver on ANY front what they said as far as advertising services go, not too mention your money which you've earned which they haven't paid out a penny (and won't most likely) either. Here's the important thing to mention - make sure you explain WHY you've taken a while to report this. I said that because I obviously had to wait months for my panels to earn anything that by the time I put in for my first withdrawal back in July and realising that it would take more than 20 days to get paid, once it started going month by month without any payment that I realised something was wrong (stating the obvious here but you need to make sure your bank realises just how slimy and manipulative BB are in stalling people while fleecing them like sheep).
And because a mass payout to affiliates was promised by the owner for end of December last year, obviously that hasn't materialised either and this is why you've started to do your own investigation on the internet to find out what's going on with these people. And you have since come across information, testimonies, forum posts, blog sites and more that all point to BB not only being a highly fraudulent company or a glorified Ponzi scheme, but some of its key players have a less than spotless history of being involved in other scams too. You also want to mention the most blatant thing of all which is what BB are doing with regards to making their affiliates pay $10 each of FRESH MONEY into the scam, sorry 'company', to enable us to keep our accounts from being terminated in 90 days.
Also mention the admin and traffic pack fees that are being taken out of your earnings in your ewallet and the fact that by you rightly refusing to pay them anymore money ESPECIALLY when they owe YOU money and that they should be able to take it out of your earnings (only there clearly ISN'T any, it's just virtual numbers on a screen), you are going to end up losing both your account (even though I'm sure you want to at this point, I know I do) but worst of all, it strings the time element along even further making it all the more harder, maybe even impossible for you to claim back any money through your bank.
This is a basic outline of what I talked about so feel free to use this but obviously put your own take on it because after all, it is your money and your claim.
I really hope this helps you and I will let you know what develops further from this. My guy said that most likely the bank will want to launch a proper investigation if the company is fraudulent as they want nothing to do with a company like that (no sh**??!!) I told the guy that there's simply not enough people kicking up an almighty stink about them and that's why (coupled with their knowledge of scamming) they are able to get away with it and seemingly dance around the law etc.

Good afternoon, folks - So I just got off the phone after ringing my bank (Lloyds) for the second time in talking to the disputes team about Bankers Broker and trying to get a chargeback. The first time I rang the other week, the lady told me I couldn't do anything as it was longer than 120 days. Well after I read the post on that Tara Talks blog site about the 120 days vs 540 days claim for chargeback, I rang again.

This time I spoke to a very helpful guy who told me after I explained a few things that the admin team would proceed with refunding my money although this could be pending on them requiring further information from me (which is what I expected). If successful, he told me I would receive my money back in 10 days as that's how long it takes the investigating team to look into it and process any monies back etc.
So what I'm basically saying is get on to you bank whoever it is, speak to the disputes team and TELL THEM that you are making the claim for chargebacks because BB simply did NOT deliver on ANY front what they said as far as advertising services go, not too mention your money which you've earned which they haven't paid out a penny (and won't most likely) either. Here's the important thing to mention - make sure you explain WHY you've taken a while to report this. I said that because I obviously had to wait months for my panels to earn anything that by the time I put in for my first withdrawal back in July and realising that it would take more than 20 days to get paid, once it started going month by month without any payment that I realised something was wrong (stating the obvious here but you need to make sure your bank realises just how slimy and manipulative BB are in stalling people while fleecing them like sheep).
And because a mass payout to affiliates was promised by the owner for end of December last year, obviously that hasn't materialised either and this is why you've started to do your own investigation on the internet to find out what's going on with these people. And you have since come across information, testimonies, forum posts, blog sites and more that all point to BB not only being a highly fraudulent company or a glorified Ponzi scheme, but some of its key players have a less than spotless history of being involved in other scams too. You also want to mention the most blatant thing of all which is what BB are doing with regards to making their affiliates pay $10 each of FRESH MONEY into the scam, sorry 'company', to enable us to keep our accounts from being terminated in 90 days.
Also mention the admin and traffic pack fees that are being taken out of your earnings in your ewallet and the fact that by you rightly refusing to pay them anymore money ESPECIALLY when they owe YOU money and that they should be able to take it out of your earnings (only there clearly ISN'T any, it's just virtual numbers on a screen), you are going to end up losing both your account (even though I'm sure you want to at this point, I know I do) but worst of all, it strings the time element along even further making it all the more harder, maybe even impossible for you to claim back any money through your bank.
This is a basic outline of what I talked about so feel free to use this but obviously put your own take on it because after all, it is your money and your claim.
I really hope this helps you and I will let you know what develops further from this. My guy said that most likely the bank will want to launch a proper investigation if the company is fraudulent as they want nothing to do with a company like that (no sh**??!!) I told the guy that there's simply not enough people kicking up an almighty stink about them and that's why (coupled with their knowledge of scamming) they are able to get away with it and seemingly dance around the law etc.

ReplyDeleteAfter a month of back and forth with my bank and after all my efforts to send them all the evidence I could (including of course about the liquidation proceedings), as of today my money has been credited back to me.
The moral of this story? If you know your rights and you are within the 540 day time frame with your chargeback claim, DON'T GIVE UP. I know I was in the right and I made damn sure to stand my ground. Banks clearly do not like trying to claw back money on your behalf, but we are not the ones in the wrong here. Banners Broker are.

Hi Jonathon, unfortunately no. You only have two options open to you if you paid cash. Firstly, sue your referrer (difficult to proof unless he/she is a well known recruiter) or secondly, add your name to the creditors list. Remember to take screen shots of all your pendings. It is your only PROOF. Good Luck!

DeleteSo it looks like my credit card that was earlier refusing, are now going to refund me. I just spoke to the person handling my "complaint" case - I complained that they ruled against me originally and that escallated my case to a complaint. The person I'm dealing with was initially very cold but today he was very nice on the phone and essentially said that with all the info I've sent in (and I've sent Mounds and Mounds of evidence and back up to my claims, etc) he could see that the trading practices of the company were very questionable.
ReplyDeleteFurther, one thing that seems to help is that I've received a chargeback from a different credit card in the meantime and that seems to help the case. In fact that was one of the main reasons they opened me a complaint case, because I said that I knew 5 people who'd been granted chargebacks from other cards in the exact same circumstances so why not me.
No one wants to hear that someone else is doing a better job than them and so that seems to help.
I'd say that this might help other people - if they know someone personally or through one of these forums in more or less the same circumstances as they are in (similar time frames, same type of card, etc) and that person has received a chargeback/refund then it will help their case if they use that information when one of the banks is umming and ahhing about it.
Also send in lots and lots of back up documentation. They don't like having to do the research for you and if you're lazy in providing evidence then your case will not go smoothly, or won't go at all.

They looked into it in great detail and still declared it not relevant and asked me to write in and explain where exactly this is written.
As far as i know it is not under section 75 of CCA which assists credit card payments, can anyone share information for visa debit card payments about 540 days rule
Jim, the link is above under 'Definition of Chargeback rules'. But your post illustrates perfectly how bank staff DONT know the rules. Barclays HAVE given chargebacks to many people who are way beyond the 120 day rule. Did you phone the call centre or speak to a manager?

I was then told to write in and explain the 540 day rule to see if a case could be open. I take it the link to send is the which consumer one? ReplyDeleteDrouche. If you funded PAYZA with cash your options are limited and PAYZA may not refund you. The chargeback rules don't include them. HOWEVER, if you funded payza via a credit card/debit card you still have some hope of success. Contact them personally and get there advice.

The questions your CC are asking are based on BB being a REAL business which it isn't. Ask to speak directly to there fraud dept and by all means give them a link to this blog. Thank you anon! The chargeback option is for credit cards and bank accounts. I'm not familiar with 'Use-My -Funds', but if you paid them with a bank transfer or credit card then you may be lucky. Give it a go, you have nothing to lose by trying. Let me know how you get on?

ReplyDeleteI joined BB in Feb 2013 and paid by CC. I also encouraged my friend and my son to join and I paid by MY CC on those occasions too. I put in for a payment in August last year and needless to say am still waiting. Then they "blacked out" for 10 days and we had to pay $10 to keep it live. I have since put in for another payment of $115.42 (the most they said I could draw) and am still waiting. We were encouraged to join World e Wallet but there seems to be a "problem" with their site so the other 2 cannot withdraw from the legacy wallet as there is no facilities. I am with STP but they are not. What do you suggest I do? BB have had many support tickets from me especially pre black out but they are no longer kept on the site. I have already sent 4 this time but they are a waste of time. What sort of info do CC companies need and should I attempt all 3 at the same time or individually? I'm talking chargeback here. I funded Allied Wallet from my CC each time.
Hi Anon, as your account is effectively dead the best option for you is to apply for Chargeback from your CC company. All the info you need is written above us. WeW will never function properly because Chris owns it and STP are only a payment processor. Chargeback is definitely your first point of call. Good Luck!

ReplyDeleteI have been in contact with my bank (NATWEST) for a chargeback, spoke to the supervisor who told me they cannot do anything as they need more proof of how much banners were going to pay me and by what method. But due to banners now asking for more money to gain access I am unable to do this. My account with BB started on the 07/11/2012 so it falls within the 540days which the bank are not disputing.

DeleteAs you have no proof of a withdrawal request, my advice is to bypass customer services and go straight to their FRAUD dept. As Banners Broker has been Officially Liquidated by a judge and its assets frozen, the bank can hardly say that there is no proof of a scam!
We have had a great success this way already so don't be deterred, be determined!

I've spoken to the fraud team and they are telling me it isnt their department that deals with it, its retail disputes (basically the chargeback team, who i have already spoken to and said they need proof) the fraud team are saying its a scam, they only deal with it if someone else made the payment with my card. Helo!! :(

Hi Jim, the bank has asked you or the liquidators? All this info is something you should have in the form of receipts for the money you paid BB or a bank statement showing that money went out? Any monies paid to you would also have some proof? The money in your BB account is worthless and has no value.

The proof that BB has been Liquidated is definitely your best defence. All the info is on this blog. You are welcome to send them any information here that may help you. But as long as you have proof of purchase then you should be ok...
DeleteHi Tara, I saw your post in regards to rules of chargeback that banks may be able to charge the money back within a period of 540 days of discovering the scam. I have been registered with BB since April 2012 (760days) and my first withdrawal request was made in June 2013 (470 days). I rang my bank (HSBC) to try and request the chargeback however they are insisting that it is too late as the chargeback can only be requested within 120 days. I have mentioned about 540 days but they say that it would not apply either because my payment to BB has lapsed 540 days too. Any advise on the above would be very much appreciated as I got an impression that 540 days apply from discovering the problem and not from the payment date?

Once again, the banks are giving out incorrect info! If your first withdrawal request was made in June 2013 then thats when the clock starts ticking and you are claiming under 'services not provided'. If they still quibble with you, go straight to their fraud dept and put in a claim there. You have been scammed, pure and simple.

Hi! I paid my first money to BB on 30/01/2013 .I was at my bank 3 times ( 05/05/2014, 19/05/2014, 20/05/2014) third time I found man who wanted to help me.I sent letter with full description about whole situation and the another documents on 22/05/2014 and 27/05/2014 I got money on my account. That man told me that I had 120 days from the date when that company bust up ( from 26/02/2014) and 540 days from when I paid second time to BB it was on 14/03/2013, but Tara said we have 540 days from the first withdrawal. I did not argue for I had still time even from 30/01/2013 it was about 480 days( limit 540), from 26/02/2014 86 days (limit 120).If you need something else I look here every day. Good luck.
DeleteBanks are all interpreting the rules differently and giving out lots of different advice but the golden rule is that you have a TOTAL of 660 DAYS FROM THE FIRST DATE YOU PUT IN A WITHDRAWAL REQUEST TO BB. And you are claiming under 'non receipt of services'. Every piece about Chargeback in every mag or newspaper etc has conformed this so don't be afraid to show the bank these posts. VERY glad you got your money back Anon!

ReplyDeleteHi James, this is a grey area. Chris uses payment processors to try and avoid chargebacks in the first place. My advice is to contact your CCC and begin the Chargeback process anyway. But go straight to there fraud dept and avoid customer services if you can. Tell them you've been scammed and follow th process through. All i can honestly say is that some HAVE managed a chargeback via this route and some haven't. Give it a go. You have nothing to lose by trying.

Update on this, i had lengthy chat with CC company who requested i tell them all transactions both on the CC and other cards, when i asked why they said they are obliged to retrieve ALL monies paid not just the one via CC. Fingers crossed!!!!

I was also controlling accounts for someone who paid 2different people in a similar way cash etc over £30000 , and panels were transferred to numerous accounts to maximise the amount withdrawable.

Hello Anon, your only hope (apart from expensive court action) is to go onto the Creditors list. Paying people in cash is the worse case scenario for anybody, My advice is too get all the evidence you have including statements, receipts, text messages(?) emails anything that can PROVE you paid the cash and file them safely. I got suspicious about BB when my account was blocked, and wanted me to pay a $15.00 USD fee ($100.00TTD) to unlock my account. They (BB) threatened to flush out all inactive accounts.

ReplyDeleteThe banks are all arranged differently and their departments have differing names but generally the Fraud department is NOT who you need to speak to. It should be regular customer services or a disputes team.
ReplyDeleteI disagree in my case because I went through those avenues FIRST and got the run around for nearly a month before they turned it over to the fraud dept who sorted it out within a week (Lloyd's Bank is who I'm with and it was a debit card payment).

Agreed Steve. Our best successes have come from the banks FRAUD DEPT. Going to Customer services now is a waste of time. You have to escalate everything, perservere, and don't be fobbed off. Above all, don't take 'no' for an answer.
DeleteYour correct anon, they do all have different names. But we have had great successes by going through the Fraud depts of some banks. The banks probably aren't to happy with this advice. Tough. They all have the resources to help bring BB down. Hopefully they will soon start taking notice.

ReplyDeleteThe only evidence you need is the money that you originally paid them. If this is the customer service dept that you went through then go to the FRAUD dept instead. You have been the victim of a scam. You were promised a service that you did not receive i.e PAYMENT and are entitled under section 75 of the Consumer Credit Cards Act for a full refund. Feel free to quote me! If they still say no, get the name of this persons manager, go higher, and if that fails, you can complain to the FCA. Details above.
It might not be 'technically correct' but it works, we've proved it. The louder we shout, the more we get heard. The more we get heard, the better chance there is of money being returned.

ReplyDeleteI too have fallen for BB's trickery way back when I was trying to find ways to make passive income online.
I paid $2600 USD total on July 27th, 2012. I never tried to withdraw any of my funds because I was putting all of the so-called "profits" back into panels. By the time I considered withdrawing, I'd already read hundreds of horror stories of people not seeing a dime.
In a sense I'd already accepted my loss.
I guess my question is: Am I doomed since I paid all the way back in July 2012? And also because I never actually requested a withdrawal?

Hi Monies plz, it sounds like you paid by cash? If that's the case then you can still contact the Liquidators and go onto the creditors list. It will take longer than Chargeback but you should still get some or all of your money back eventually. If you paid by CCC or bank then my advice is to try for a Chargeback anyway. You might have a sympathetic person to help you and get the matter resolved quickly, or not. Either way, if you don't ask, you won't get. Good Luck!

His banners account was paid via a Barclaycard and they are saying Upon investigation the name of the merchant that has debited the account is "E.W Banners" This means that the supplier portion of "the debtor-creditor-supplier" crtieria has not been met. E.W. is an E-wallet used to take payments to this company and is classed as a third party.
I know many friends that have got money back and I am sure people have overcome this objection on this page and look forward to hearing your suggestions.

Anon, I am guessing you were the previous 'ANON' who made comments about banking systems? My previous reply stands because the majority of agreed Chargeback claims (of which there are numerous examples) have come from 'Third Party' Chargebacks because BB has always insisted on a payment processor to channel the funds. It hasn't been a reason to prevent Chargebacks before, so Barclaycard have no reason to with-hold a Chargeback based on Third Party reasoning.
DeleteI have been advising on Chargeback for many months and have had feedback from many, many affiliates. The majority tell me that ALL CCC have refused their request in the first instance and have given them huge hoops to jump through.
The affiliates that are successful are the ones who stand there ground and don't give up.
Ultimately, all Chargebacks are (or should be) claimed back from Banners Broker by the banks or CCC themselves. This will hasten BB's demise, which another reason why I push Chargeback so hard.
Thats just an excuse Anita. Try again. This time say that you want to speak to their fraud/escalation dept.You have been scammed. Period. BB have not provided the services they promised you i.e they haven't paid you! Feel free to direct Barclaycard to this blog and the numerous success stories posted above. Don't forget to mention that they have been LIQUIDATED and their assets are frozen. That usually does the trick! Let me know how you get on?

ReplyDeleteHi Anon, any cash payments you made are lost I'm afraid unless you take your referrer to the Small Claims Court. And if you made your payment to Allied Wallet through your bank/CCC then it is still worth a shot. But your best bet now is to join the Creditors List.

It will be difficult to show that the funds were directly intended for BB accounts, which is a pity as it's several thousands.

Hello JP. If you funded STP via your credit card/ debit card then it is still worth a shot at applying for a Chargeback. But registering with the Liquidators is your best hope now.

ReplyDeleteHello Vlad. Contracts have not been a major reason for refusing a Chrgeback so I'm not sure why they would say that but it sounds like they don't understand the nature of your Chargeback. Go straight to there FRAUD dept and tell them that you are the victim of a scam. Tell them that Banners Broker has been Liquidated, there assets frozen, and RECEIVERS have been appointed in Canada..And above all, do NOT wait for an answer from them. KEEP phoning them. Everyday if need be.

Hi Anon - many thanks. All you can do then is take an 'educated guess'. Add a year onto the date when you joined. It probably won't be that far out and you are also still probably with in the total Chargeback time frame of 660 days.

Hi Dave, Chargeback is no longer a guaranteed option for you, but if you paid by Credit Card, you may still be able to get some back. Some companies are more sympathetic than others. Realistically through, your best bet is probably the Liquidators. See my Liquidators page for more details.

According to your article the time limit to apply for a chargeback is 660 days (540 + 120) from the date we applied to withdraw. Can you confirm this is correct? - Natwest have declined my request for a chargeback as they state I am outside this period.

Hi James, in theory, yes. But the Chargeback windows are all closing rapidly now unfortunately. The 540 day limit is from your transaction date and at any time with-in that period i.e the date when you realised BB weren't going to pay you, you then have a further 120 days to claim. A year or so ago when I first started this page, the timings weren't so important. Now they are, which is why some of the older advice posted here is now conflicting. Unfortunately for you, the window has closed, but I would still advise you to try. We are still getting good results from sympathetic Credit Card companies despite the rules. Realistically through, your only real hope is the Liquidators Crediors List.

The rest was on a debit card BUT the interesting thing is IF i can provide a document or evidence to show a clear link between Allied Wallet and EW Banners, they will look at refunding even the payment made on the debit card (which is with different provider!)

I am trying to do a Section 75 claim from my credit card company. My payments (outside the chargeback - I already got £3k back from chargeback) were made through STP and my credit card statement shows the payments going to "EW-Banners". The credit card company have said that I haven't proven that "EW-Banners" is the same as Banners Broker - does anyone know how I can do that?

This might be all too late for me but here's my situation... I funded 3 separate money transactions by UK bank transfer using my Northern Rock account into Allied Wallet. These were done in mid to late 2012 but I never put a withdrawal request for at least a year.

If the bank won't accept the fact that they've been liquidated AND the website is closed, you need to talk to somebody else. Are you in contact with the FRAUD dept or cust services? If your bank is featured on my Chargeback success stories, you could show them that? Time is getting on now for bank refund successes. The liquidator is probably the best option for you now, but keep going as far as you can with your bank in the meantime.

Later I encouraged my sister to join too, and funded her account myself with the same CC. Neither of us received any withdrawals from BB. As far as I understand it's too late to request chargeback, so the Liquidators are my only chance now.
I've got bank statements for these transactions and emailed Purchase notifications from Allied Wallet - all of them issued in my name, while some of this money went to my sister's account and hence the email notifications of eWallet Loading from BB are addressed to her (I effected payment from her BB account, but using my credit card). Can I claim this money myself, based on my bank statements, or my sister should place a separate claim of debt? Or maybe I should enclose a notarized Assignment of Claim from her? I’d greatly appreciate your advice.
Hello Olga. If YOU funded the accounts with your own money then it's you that must claim, not your sister. The liquidators will advise you so please phone them directly - they are very helpful.

By the way, what amount can we claim - only the initial investment that can be proved by a bank statement? Not any "earnings" from the BB Legacy wallet? I'm asking because I know that some people have indicated the amount of their "earned money" in the Claim of Debt, though I have no idea what was the outcome of it.
OK, they know what they need. As for your 'earnings' it's seed money only. If you claim for anything over and above that it will be refused.

Unfortunately, the Bank is within its right to refuse a Chargeback because you went through a third party processor -PayPal. Have you put in a Payza withdrawal? Try PAYPAL first, then go to the Authorities and REPORT TM and Charles. Getting TM closed down is your best hope of getting funds recovered.

It is correct, but has never been tried before (to my knowledge) and we'd love somebody to give it a go. If you live in the UK, you can claim through the 'small claims court' and the costs depend on the amount claimed. If you decide to go through with it, let me know?

Very sorry to hear that Guntars, but Plusoption is a scam . Please report them to the authorities in your country. If you paid by Credit card through, you may be covered under the 540 day rule. If plusoption have given you the service you paid for? Go to your CC fraud dept and ask them.

ReplyDeleteI have followed your steps and have gone through PayPal to reclaim my money however it was rejected. I then requested a chargeback with my bank Barclays however it was rejected also but I requested another chargeback which again was rejected because I have attempted it once already they said. I then called up Barclays and after speaking to a staff member and supervisor they have said they've tried everything they can and will not be able to get the money back from traffic monsoon.
I have threatened the bank by saying I will go to the Financial Omsbudman and they encouraged me to try this route.
Could you please advise me on what I can do now?
I paid out £1,800 and am devastated that I will not be getting my money back.

The banks do not legally have to refund you, they follow a voluntary code. It's only Credit Cards that apply the 540 day rule. Having said that, many banks have refunded and it is certainly worth trying the Omsbudman. You must also apply to the Receivers to become a creditor.

If you are referring to Traffic Monsoon, you have the option of contacting the receiver to put in a claim. If this is My Advertising Pays, your only option at the moment is to report this to the Securities and Exchange Commission and Action FraudUK.

A bank wire is the same as cash and has no protection from Chargeback rules. But you can definitely put in a claim with the receiver. Details on Home page, first post.
ReplyDeleteHi Tara, I used online banking to carry out my purchases providing my debit card details as a means of payment. These transactions go back as far as Feb 2016, do I stand a chance ?
ReplyDeleteIf you made a purchase for services, and didn't get that service as promised, then yes, you can apply to your bank for a Chargeback using the 540 day rule.

ReplyDeleteWith regard to chargeback (thanks for the advice btw) I note that The Advert Platform are still (June 2017) advising former MAP members to "be patient", new legal action will commence in Panama, soon (Ha!).
Can you clarify for me how the 120 day and 540 day rule works. Is it 120 days from the original transaction, 120 days from when a return would have been available (i.e., a reasonable time for the investment to have matured and then to withdraw the funds), 120 days from when MAP froze accounts, or 120 days from when we give up on trying to obtain the money from MAP using other means? Visa recommends consumers try to gain a refund from the merchant before requesting a chargeback and this takes time.
Is it the case that because MAP are still advising that legal proceedings are under way, that the 120 day limit could apply from their June communication?
Alternatively, having purchased packs in August 2016, would a chargeback claim be considered under the 540 day rule (the justification being having tried other avenues to recoup the lost money)?

Hi G. The 120 day rule doesn't apply in this case. Only the 540 day rule does for 'services not received'. Chargebacks for MAP have been hard to get and many have had them reversed as MAP haven't yet been closed down Officially. Please make sure you report this scam to The Securities and Exchange Commission.
DeleteThanks Tara. On a positive note, I spoke with the Fraud rep from my bank, and he is genuinely interested in pursuing this on my behalf. He advised obtaining as much evidence as I could before making the application.
ReplyDeleteWhen I asked The Advert Platform why I shouldn't just request a chargeback, they responded promptly - I can, but if I do and it is unsuccessful, then my accounts will be blocked, so I should wait until it has been resolved legally with VX.
My argument centres on the fact that MAP acknowledged receipt of payment by crediting to my account credit packs which were active, even if only for a short period. That they then froze the account is a denial of service. To a degree, it matters little "where" the money is, that is a matter for the issuing and acquiring banks to sort out with the card processor (Visa) and the merchant. Anyway, fingers crossed, I'll keep you updated.
